1. About these terms
These Terms of Service ("Terms") govern your use of NaijaMoto (naijamoto.com, the dealer dashboard and related services), operated by Mane Automobile Limited (RC 8498634), 77 Awolowo Road, Ikoyi, Lagos, Nigeria ("NaijaMoto", "we", "us").
By creating an account or using NaijaMoto you agree to these Terms and to our Privacy Policy. If you use NaijaMoto for a business, you confirm you are authorised to accept these Terms for that business.
2. Who can use NaijaMoto
- You must be at least 18 years old.
- Business accounts are for dealerships, importers and other businesses that sell vehicles, and their authorised staff.
- You must give accurate information and keep it up to date, keep your password secure, and tell us promptly at admin@naijamoto.com if you think your account has been misused. You are responsible for activity on your account.
3. NaijaMoto is a marketplace, not a party to sales
NaijaMoto lets businesses list vehicles and lets buyers find and contact them. We do not own, sell, inspect, ship or clear the vehicles listed, and we are not a party to any sale. We do not hold or process payments for vehicles (no escrow), and any agreement is solely between the buyer and the seller.
Buyers should always inspect a vehicle (ideally with a mechanic), check its documents and match the VIN before paying, and pay only into a bank account in the selling company's exact name. Never pay for a vehicle you have not inspected.
4. Verification badges
- The Verified Dealer (green star) and Verified Importer (blue star) badges mean we reviewed the documents listed on our verification pages and they appeared genuine at the time of review.
- A badge is not a guarantee, endorsement or warranty of a business, its vehicles, their condition or their customs status.
- Badges are re-verified periodically (documents such as tax certificates are checked annually). We may suspend or remove a badge if documents expire, information changes, or we have concerns about fraud or misconduct.
- You must submit only genuine documents that belong to your business. Submitting false, altered or someone else's documents will lead to permanent removal and may be reported to the authorities.
5. Listing rules
When you list a vehicle you confirm that:
- you own it or are authorised to sell it, and it is not stolen, subject to undisclosed finance or otherwise unlawful to sell;
- the details are accurate — make, model, year, mileage, condition (Brand New, Tokunbo or Nigerian Used), customs duty and registration status, price in naira;
- you include at least 5 real photos of the actual vehicle, which you own or have permission to use;
- one car has one live listing: you will not post duplicates of a vehicle already live on NaijaMoto, including one listed by another business;
- you will update or mark the listing sold promptly when it is no longer available.
Every listing is reviewed before it goes live. We may decline, edit the presentation of, or remove listings that break these Terms, look like duplicates, spam or bait (for example placeholder prices), or that we reasonably believe could mislead buyers.
6. What you must not do
- Commit or attempt fraud, advance-fee or deposit scams, or ask buyers to pay before inspection through unofficial accounts.
- Impersonate another person or business, or misrepresent your relationship with a business.
- Send spam, unsolicited bulk messages, or messages that break a connected platform's rules.
- Harass, threaten or discriminate against other users.
- Scrape, copy or resell NaijaMoto data or listings without our written permission, or interfere with the security or operation of the service.
- Use NaijaMoto for anything unlawful, including dealing in stolen vehicles or evading customs duty.
7. Messaging and connected channels
- Buyers need a free account to message businesses through NaijaMoto chat. Businesses must answer buyers honestly and must not use buyer contact details for unrelated marketing without consent.
- Verified businesses may connect TikTok, Facebook Messenger, Instagram and other channels. By connecting a channel you confirm you control that account and authorise us to receive and send messages on its behalf.
- You must follow each platform's own terms and policies, including their reply windows and message limits (for example TikTok's 48-hour window and 10-message limit, and Meta's 24-hour window). If a platform suspends or changes its service, the related NaijaMoto feature may stop working.
- You are the controller of your customers' messages and are responsible for how you use them; we process them for you as described in our Privacy Policy.
8. AI assistant
- The AI assistant can draft listings, suggest prices, organise listings and draft replies. Its output may be inaccurate or incomplete.
- It only proposes actions — you decide whether to approve them, and you are responsible for anything you publish or send, including prices and statements about a vehicle.
- Price suggestions are based on comparable listings on NaijaMoto and are not valuations.
9. Fees and paid plans
- Creating an account and listing vehicles is currently free.
- NaijaMoto Pro is a paid subscription for businesses, currently ₦20,000 per month, with the features described on our pricing page at the time you subscribe. Applicable taxes are shown at checkout.
- Subscriptions are billed monthly in advance through Paystack and renew automatically until cancelled. You can cancel at any time in your dashboard; cancellation takes effect at the end of the current billing period and you keep Pro features until then.
- Fees are non-refundable for partial periods, except where required by law or where we end your subscription without cause.
- We may change prices or introduce other paid features (such as featured or boosted listings). We will give at least 30 days' notice before a price change affects your subscription.
- If a payment fails, we may pause Pro features until it is resolved.
10. Your content and our licence
You keep ownership of the photos, videos, descriptions and other content you upload. You give NaijaMoto a non-exclusive, worldwide, royalty-free licence to host, store, copy, resize, display and distribute that content to operate and promote the marketplace (for example on our homepage, in search results and on our social media), for as long as it is on NaijaMoto and for a reasonable time afterwards to remove it from backups and existing promotions.
You confirm you have the rights to grant this licence and that your content does not infringe anyone else's rights. If you send us feedback or ideas, we may use them without obligation to you.
11. Our intellectual property
The NaijaMoto name, logo, design, software and content we create belong to Mane Automobile Limited or our licensors. You may not use them without our written permission, except to share links to NaijaMoto listings.
12. Suspension and termination
You can close your account at any time from your settings. We may suspend or close an account, remove listings or badges, or limit features if you break these Terms, if we suspect fraud or a risk to other users, or if the law requires it. Where appropriate we will tell you why and how to appeal by emailing admin@naijamoto.com.
Sections that by their nature should survive termination (including licences already granted for removal, disclaimers, liability limits, indemnity and disputes) continue to apply.
13. Disclaimers
NaijaMoto is provided "as is" and "as available". To the extent permitted by law, we do not guarantee that listings, prices, badges or messages are accurate or complete, that any vehicle is as described, or that the service will be uninterrupted or error-free. Nothing in these Terms limits rights you have under the Federal Competition and Consumer Protection Act 2018 or other law that cannot be excluded.
14. Limitation of liability
To the extent permitted by law, NaijaMoto is not liable for:
- any vehicle, transaction or dispute between buyers and sellers, including payments made to sellers;
- loss of profits, revenue, business, goodwill or data, or any indirect or consequential loss;
- actions or outages of third-party platforms such as TikTok, Meta, Google or Paystack.
Our total liability for any claim relating to NaijaMoto is limited to the greater of (a) the fees you paid us in the 12 months before the claim and (b) ₦50,000. Nothing limits liability for fraud, or for death or personal injury caused by our negligence, or anything else that cannot be limited by law.
15. Indemnity
If you use NaijaMoto for a business, you agree to compensate NaijaMoto for reasonable losses and costs (including legal fees) arising from your listings, your dealings with buyers, your use of connected channels, or your breach of these Terms or the law.
16. Governing law and disputes
- These Terms are governed by the laws of the Federal Republic of Nigeria.
- If a dispute arises, please contact us first at admin@naijamoto.com; we will try to resolve it within 30 days.
- If it is not resolved, it will be referred to arbitration administered by the Lagos Court of Arbitration under its rules, seated in Lagos, in English, before a single arbitrator.
- Either party may apply to the courts of Lagos State for urgent interim relief, and consumers keep any right to bring a claim before the courts or the Federal Competition and Consumer Protection Commission that cannot be excluded by contract.
17. Changes to these terms
We may update these Terms as NaijaMoto evolves. We will post the new version here with a new date and, for material changes, notify account holders at least 14 days before they take effect. If you keep using NaijaMoto after that, the updated Terms apply.
